Thailand Visa

 Prohibitions and restrictions on import

Customs authorities in Thailand are very strict about the local laws that governing the import and introduction of specific categories of goods. It is absolutely prohibited to bring into the country certain categories of goods, such as pornography, products and counterfeit money, the endangered animal, any kind of drugs and medicines, if not accompanied by a prescription in English. The penalties are severe, economic fines for some products, for drugs, even small quantities, it is applied imprisonment. Can be introduced in Thailand duty-free up to 200 cigarettes, or up to 250 grams of tobacco or a mixed amount of the two articles, a total weight not exceeding 250 grams; it's allowed entry with a maximum of one liter of spirits or wine. The exceeding this limit results in a payment to the border crossing at very expensive fines. For other goods, finally, the import and export is restricted. Firearms and ammunition require a special permit issued by the National Police. Spare parts for vehicles: they can not be imported free of duty and require a permit from the Ministry of Industry. Antiques and objects related to religion can not be exported without a permit issued by the Department of National Museums.

 Pets

Dogs and cats must have a health certificate in English, signed by veterinarian of the country origin stating: age, race, sex, color and species of the animal and also the name and address of the owner or the farm. The animals must be vaccinated at least 21 days before departure against: rabies, distemper, leptospirosis, hepatitis, parvovirus. It may happen that the animal is quarantined and subjected to medical tests, at the expense of the owner.

As a foreigner, you are required by Thai Immigration Law to initially enter the Kingdom on a Visa if you wish to have a long-term stay in Thailand.

 Tourist Visa

Tourist Visa is issued by Thai embassy or consulates in the world before leaving for Thailand, going in person or delegating someone to deliver the passport with the required documents. This is a 60-day Tourist Visa to Thailand that can either be a Multiple or Single Entry Visa and can be extended for up to another 30 days by means of a visa run to a border country.

Re-Entry Permit. Foreigners, holder of any type of Visa, who wish to leave and reenter the country before the expiration date of the visa without having to apply for a new Visa, must apply a re-entry permit before leaving. Otherwise, the visa will be automatically canceled, even if not yet expired. This permit can be obtained at all Immigration Offices in Thailand, but also to the International Airports of Bangkok, Chiang Mai, Phuket, Hat Yai, and Sukhothai, as well as other Immigration checkpoints throughout the country, on arrival or a few days before leaving Thailand. The rate for single return is 1000 THB while the multiple re-entry permits are 3,800 THB.

 Non-Immigrant Visa O-A, Long Stay

These types of visas are issued to foreign applicants wishing to stay in the Kingdom for a period of three months to a year. Various categories of the Non-Immigrant Visa are currently provided to meet the needs of foreigner. For owners of all types of Visa O-A employment of any kind it is strictly prohibited. Working in Thailand without a Work Permit is a serious crime, which envisages fines or imprisonment.

Non-Immigrant Visa O, Family Reunion. This type of visa is issued to applicants who wish to accompany a consort or family members, foreign or Thai citizens, which are working, studying or living in Thailand. The applicant may submit an application at the Thai Diplomatic Missions in the country of residence. The validity of a visa is 3 months for Single Entry Visa, 2,000 THB. Documents required: passport or travel document with validity not less than 6 months; visa application form completely filled out; recent photograph of the applicant; company or school's guarantee letter addressed to the Thai Consulate stating that the applicant is consort or family members of those working or studying in Thailand; copy of passport pages of those working or studying in Thailand, the passport pages should include personal data page and Thai visa page; copy of Thai Work Permit or Student I.D.; copy of marriage certificate, for consort; copy of birth certificate, for parents. Holder may apply for an extension of stay at the Office of the Immigration Bureau and may be granted such extension for a period of one year from the date of first entry into Thailand.

Non-Immigrant Visa O, Voluntary Services. This type of visa is issued to applicants who wish to participate in voluntary services in Thailand. The applicant may submit an application at the Thai Diplomatic Missions in the country of residence. The validity of a visa is 3 months for Single Entry Visa, 2,000 THB. Documents required: passport or travel document with validity not less than 6 months; visa application form completely filled out; recent photograph of the applicant; recommendation letter addressed to the Consulate; copy of registration certificate of the employer/foundation/organization; copy of the previous/current work permit, if any; copy of the employment contract, if any. Consular officers reserve the rights to request additional documents as deemed necessary. Holder may apply for an extension of stay at the Office of the Immigration Bureau and may be granted such extension for a period of one year from the date of first entry into Thailand.

Non-Immigrant Visa O-A, Retirees. This type of visa is issued to applicants who wish to stay for Long Time in Thailand, but not for work. This visa authorizes the holder to remain until one year. Applicants must: be older than 50 years; not to have the ban on entry into the Kingdom; be under suspicion both in Thailand and in the country of origin and residence; have both citizenship and residence in the country where the applicant has filed the application for the visa; be free from prohibited diseases as well as not being drug addicts. The applicant may submit an application at the Thai Diplomatic Missions in the country of residence or at the Office of the Immigration Bureau in Thailand located on Government Center B, Chaengwattana Soi 7, Laksi, Bangkok 10210, Tel: +66 2 1419889. The visa fee is 5,000 THB for Multi-Entry. Documents required: passport with validity of not less than 18 months; 3 copies of completed visa application forms; 3 passport-sized photos of the applicant taken within the past six months; 3 copies of personal data form or CV: 3 copies of bank statement showing a deposit of the amount equal to and not less than 800,000 Baht or an income certificate, an original copy, with a monthly income of not less than 65,000 Baht, or a deposit account plus a monthly income totaling not less than 800,000 Baht; in the case of submitting bank statement, 3 original copies of letter of guarantee from the bank are required; 3 copies of certificate confirming that the applicant has no criminal record issued by a competent authority in the country of residence; 3 copies of medical certificate issued in the country where the application is made in which both stated that the applicant is not suffering from diseases such as tuberculosis, elephantiasis, and the third stage of syphilis in addition to not being a drug addict. The certificate must not be older than three months from the date of submission of the application and must be authenticated by a notary public or diplomatic bodies of the country of the applicant. In the case where the accompanying consort is not eligible to apply for the Visa O-A, Long Stay, he or she will be considered for temporary stay under Visa O. A marriage certificate must be provided as evidence and should be notarized by notary organs or by the applicant’s diplomatic or consular mission. Foreigner who wishes to extend his or her stay shall submit a request for extension of stay at the Office of the Immigration Bureau with documented evidence of money transfer or a deposit account in Thailand or an income certificate showing an amount of not less than 800,000 Baht or an income certificate plus a deposit account showing a total amount of not less than 800,000 Baht. A one-year extension of stay shall be granted at the discretion of the Immigration Officer to the foreigner as long as he or she meets the above requirements.

Recommendations. The foreigners with Non-Immigrant Visa O-A, Long Stay, upon arrival the holder of this type of visa will be permitted to stay in Thailand for 1 year from the date of first entry. At the end of the 90-day stay the foreigner must report to the Immigration Office in his or her residence area, and report again every 90 days during his or her stay in Thailand. The foreigner may report to the police station if there is no immigration office in his or her residence area. Foreigner may report to the competent authority by post and should provide the following: A report form, Tor Mor 47; a copy of passport pages showing the foreigner’s photo, personal details, and the latest arrival visa stamp; a copy of the previous receipt of acknowledgement; a self-addressed envelope with postage affixed. Such documents must be sent to the Immigration Division 1, 120 Moo 3, Government Center B, Chaengwattana Soi 7, Laksi, Bangkok 10210 and must be submitted 7 days before the end of every 90-day period. A receipt of acknowledgement will be given and should be used for future correspondence.

 Visa Non-Immigrant B, Work and Business

This type of visa is issued to applicants to foreigners who wish to work, conduct business or undertake investment activities in Thailand must apply for a Non-Immigrant Visa at the Royal Thai Embassies or Royal Thai Consulates-General in the country of residence. Various categories of the Non-Immigrant Visa are currently provided to meet the needs and qualifications of individual business persons. These include business visa Category B, business-approved visa Category B-A, and investment and business visa Category IB. The visa fee is 2,000 Baht for Single-Entry with three-month validity and 5,000 Baht for Multiple Entries with one-year validity. Holder of this type of visa wishing to work in Thailand must be granted a work permit before starting work. Upon entry into the Kingdom applicant or his or her appointed representatives must apply for a Work Permit at the Office of Foreign Workers Administration, Department of Employment, in which the applicant will be obligated to pay income tax accordingly. If the applicant’s associated company is located in the provinces, the applicant must apply at the Employment Office of that province.

Visa Non-Immigrant B, Work. This type of visa is issued to applicants who wish to enter the Kingdom to work. Documents required: passport or travel document with validity not less than 6 months; visa application form completely filled out; recent photograph of the applicant; evidence of adequate finance, 20,000 Baht per person and 40,000 Baht per family; letter of approval from the Ministry of Labour. To obtain this letter, the applicant’s prospective employer in Thailand is required to submit Form WP3 at the Office of Foreign Workers Administration, Department of Employment, Ministry of Labour Tel. +66 2 2452745, or at the Provincial Employment Office in his or her respective province. Visa Non-Immigrant B, Business: This type of visa is issued to applicants who wish to enter the Kingdom to conduct business. Documents required: passport or travel document with validity not less than 6 months; visa application form completely filled out; recent photograph of the applicant; letter from the applicant’s company indicating the applicant’s position, length of employment, salary and purpose of visitl to Thailand; documents showing correspondence with business partners in Thailand; evidence of financial status in the case where the applicant is self-employed; letter of invitation from trading or associated partners/companies in Thailand; corporate documents of associated partners/companies in Thailand such as: business registration and business license, list of shareholders, company profile, details of business operation, map indicating location of the company, balance sheet, statement of Income Tax and Business Tax, Por Ngor Dor 50 and Por Ngor Dor 30 of the latest year, value-added tax registration, Por Por 20. Copies of company documents must be signed by the Board of Directors or authorised managing director and affix seal of company.

Non-Immigrant Visa category B-A, Business Approved Visa. The granting of such visa to qualified applicants is under the jurisdiction of the Office of the Immigration Bureau in Bangkok. The applicant’s associated company in which he or she will invest in or conduct business with may apply for this type of visa on behalf of the applicant at the Office of the Immigration Bureau. Once the application is approved, the Immigration Bureau will advise the concerned Royal Thai Embassy or Royal Consulate General via the Ministry of Foreign Affairs to issue the visa to the applicant. The holder of this category B-A visa will be permitted to stay for a period of one year from the date of first entry into the Kingdom.

Non-Immigrant Visa Category IB, Investment and Business Visa: This type of visa is issued to foreign citizens employed to work on investment projects which are under the auspices of the Board of Investment of Thailand, BOI. Such projects must be involved in or bring benefit to Thailand in the following ways: Export-promotion; Increasing employment; Utilising local raw materials; Projects engaging the provinces; Encouraging technology transfer to Thai nationals; Not hindering existing domestic businesses.

Non-Immigrant Visa Category B, Teaching. For foreigners who intend to take up employment as school teachers at the levels below university level in Thailand.Documents required: Passport or travel document with validity of not less than 6 months; Completed visa application form; Recent passport-sized photograph of the applicant taken within the past 6 months; Letter of acceptance from employing institute or school in Thailand; Letter of approval from government agencies such as the Office of the Private Education Commission, the Office of the Basic Education Commission; Evidence of educational qualification such as diplomas or teaching certificates; School license or business registration, list of shareholders and school profile; Applicant’s resume; Police certificate verifying that applicant has no criminal record or equivalents or letter issued by authorised agencies in applicant’s country.

Non-Immigrant Visa ED, Student. This type of visa is issued to applicants who wish to study, attend seminar, training session, or internship in Thailand. Foreign students are required to apply for a visa at the Thai Embassy or Consulate General in their residence country. Holder of this type of visa is entitled to stay in Thailand for a maximum period of 90 days. The visa fee is 2,000 Baht for Single-Entry. Foreign students can obtain an extension of stay at the Office of Immigration Bureau and may be granted an extension for a period of one year from the date of first entry into Thailand. Documents required: Passport or travel document with validity not less than 6 months; Visa application form completely filled out; Recent photograph of the applicant; Recommendation letter addressed to the Consulate; Letter of acceptance from the concerned academic institute/organization; For those wishing to study in a Private institution, an official letter from the Ministry of Education of Thailand, or other sub-authorities concerned, approving the enrolment of foreign students and a copy of registration certificate of the concerned academic institute are required; Academic record and the Student ID, if currently studying; For those wishing to attend seminar, or training session, or internship, a recommendation letter from the concerned organization addressed to the Consulate is also required.

 Permanent Address

Obtaining a residence in the Kingdom of Thailand brings with it a number of considerable advantages, of which the first end of the burdens of stay subject to periodic release of visas. The Minister of the Interior is responsible for the communication of the annual quota of available residences that normally stood on one hundred units throughout the Kingdom of Thailand. Evaluation questions can be submitted from October to December, from the date of announcement until last working day of the year. The bureaucratic process is pretty slim, and the results are announced in the following month of May, while the residence booklets are issued in the following month of December. Upon the achievement of the residence, the alien is released at the same time, similar to those owned by Thai citizens, identification and can be included in Tabien Baan, the house registration. By obtaining the residence are simultaneously streamlined and simplified procedures for the issuance of work permit which, however, remains the title essential to perform a work activity.  Citizenship

The release of Thai Nationality is regulated under the Act BE 2508, AD 1965. Foreign nationals who wish to request it, must meet the following requirements: be of age; perform a work activity and thus be adequately salaried or regularly receive subsidies or monthly income equivalent to the salary; have resided in the Kingdom over the past 10 years for a continuous period of not less than 5 years; demonstrate knowledge of the Thai language; be criminally uncensored. Marriage with a Thai and / or be parents of children born or studying in the Kingdom constitute an advantage for the acceptance of the citizenship. The application must be submitted, accompanied by the required documentation, to the Criminal Investigation Division Group I, Subdivision 3, Police Department, Rama I Road in Bangkok for its evaluation. The cost of the practice is very low, but the bureaucratic process has a very long time that can last for years. In the case of children born from the union of mixed couples and that they are dependents of a parent Thai, it is necessary to show the sources of livelihood and providing birth certificates of children.
